TERMS AND CONDITIONS OF USE AND SALE – KINALI

1. GENERAL PROVISIONS AND ACCEPTANCE This agreement governs the use of the website www.kinalinutrition.com and the commercial transactions conducted on it. By making a purchase, the user declares that they are of legal age and accepts these Terms and Conditions in their entirety. KUATI INVESTMENTS, S. DE R. L., with its registered office in Panama, reserves the right to update these terms in compliance with applicable law.

2. PRODUCTS AND PRICES

• Description: Images are for reference only; however, we guarantee that the content and nutritional value correspond to what is indicated on the label.

• Prices: All prices are expressed in Balboas (B/.) or Dollars (USD). In accordance with Law 45, the final price must include all applicable charges and taxes (7% ITBMS if applicable to the specific item).

3. PURCHASE AND PAYMENT PROCESS The sale is finalized once the system confirms payment and issues the electronic invoice or legal receipt. We reserve the right to cancel orders due to obvious pricing errors or lack of inventory, proceeding to issue a full refund to the customer.

4. SHIPPING AND DELIVERY POLICY

  • Delivery Times: Delivery times are estimates.
  • Disclaimer: We are not liable for delays or failure to deliver due to force majeure or unforeseeable circumstances (road closures, riots, natural disasters).
  • Packaging: The customer acknowledges that the shipping box or bag is intended to protect the product. Claims for cosmetic damage to the outer packaging will not be accepted if the primary protein container and its security seal are intact.

5. RETURN POLICY AND WARRANTY In compliance with Law 45 of 2007:

  • Manufacturing defects only: Returns are accepted only for hidden defects, broken factory seals, or products that were expired at the time of delivery.
  • Restrictions: There is no right of withdrawal based on taste, texture, or customer errors in selecting the product.
  • Requirements: The customer must present the original invoice and the product with at least 80% of its contents remaining.
  • 6. HEALTH DISCLAIMER The products sold are dietary supplements and not medications. The user is responsible for consulting a healthcare professional before consumption. KUATI INVESTMENTS S. DE R. L. is not liable for allergic reactions or effects resulting from unreported pre-existing medical conditions or from improper use of the product.

7. DATA PROTECTION (LAW 81) We process your personal data in accordance with the principles of fairness and purpose limitation. Your information will be used exclusively for the purposes of sales, shipping, and legal compliance. 9. JURISDICTION AND APPLICABLE LAW Any dispute arising from this contract shall be resolved under the laws of the Republic of Panama. In the event of consumer complaints, the parties submit to the authority of ACODECO and, failing that, to the ordinary courts of Panama City.
